iGaming Marketing – The ICO and PECR

During November 2016, hundreds of UK based Casino Webmasters and iGaming Affiliates received a 6 page letter in the post from the UK’s Information Commissioner’s Office. With the ICO alleging that the recipients of the letters sent out were partaking in the sending out of unsolicited emails and sms text messages.

It transpires that the ICO obtained the list of addresses from Income Access who provide affiliate software and affiliate marketing services for iGaming companies.

However, the ICO have not ascertained whether those affiliates of which they were provided the details of, have actually taking part in the actions they alleged them to have done.

Therefore, to hopefully provide clarification for webmasters, particularly those which operate and reside in the UK, I spoke to Tom Galanis of Tag Media to find out what iGaming affiliates need to be aware of should they decide to send out communications to players.

Casino Webmasters and Affiliates also need to read up on PECR or the Privacy and Electronic Communications Regulations as this covers all aspects of direct marketing, inclusive of email and text sms messages.

Areas covered include what webmasters should do in the event of receiving a communication from the ICO and how to respond. How to ensure any data that you hold and how you handle said data is compliant with the regulations. Along with what you need to be aware of, to ensure you are operating your website or websites within the law in the UK and also EU.
